Terms of service

These terms and conditions apply to all agreements between you as a customer and BRUSH, whether they are:

  • Made via our webshop at www.brushhm.com, or

  • Related to services and appointments at our salon, booked online, by phone, or in person.

By purchasing from our webshop or booking an appointment at our salon, you agree to the following terms.


WEBSHOP TERMS

1. Scope

These terms apply to all purchases made via our webshop, including physical products and digital (gift) cards.

2. Product Information

We do our utmost to provide accurate product descriptions and images. However, actual colors, packaging, or finishes may vary slightly. Obvious errors or inaccuracies do not bind us.

3. Prices & Payment

  • All prices are listed in euros and include VAT.

  • Payment is due at checkout, via the secure payment methods available.

  • Orders are only confirmed once payment is successfully completed.

4. Shipping & Delivery

  • We aim to dispatch orders within 1–3 business days.

  • Shipping costs are clearly displayed during checkout.

  • If an item is out of stock or delayed, we will notify you promptly.

5. Right of Withdrawal (Returns)

  • You have the right to cancel your order within 14 days of delivery, without stating a reason.

  • After cancellation, you must return the item(s) within 14 days. Once received in good condition, we will refund the full purchase amount, including standard shipping fees.

  • Returned products must be unused, undamaged, and in their original packaging.

  • Return shipping costs are at your own expense.

  • Due to hygiene, opened cosmetic products or personal care items are non-returnable.

6. Complaints

If you have a complaint about a product or service, please email info@brushhm.nl within 7 days of receiving your order. We will aim to respond within 3 business days.


SALON TERMS

1. Applicability

These terms apply to all appointments made for services at BRUSH.

2. Booking via Our Website

When booking an appointment through our booking system at www.brushhm.com, you must provide accurate and complete information. Incorrect or incomplete data may invalidate your appointment and void any right to a refund.

3. Appointment Confirmation

Appointments booked online, by phone, or in person are considered final once submitted, but may only be confirmed after a required deposit has been received, where applicable.

It is the client’s responsibility to provide accurate contact details and to keep track of their appointment date and time.

BRUSH is not responsible for missed communications due to incorrect contact information, spam filters, or technical issues.

4. Cancellations & Rescheduling

  • You may cancel or reschedule your appointment free of charge up to 48 hours before the scheduled time.

  • Changes made within 48 hours of your appointment will result in a charge of 50% of the total service fee.

  • This applies regardless of the reason, including illness or emergencies.

  • Changes must be made via your confirmation email or by phone during opening hours.

  • No refunds will be issued for late cancellations or rescheduling, unless we decide otherwise at our discretion.

5. No-Shows & Late Arrivals

  • No-shows (failure to show up without notice) will be charged 100% of the service fee.

  • If you arrive more than 15 minutes late, we reserve the right to shorten or cancel your appointment. In either case, the full service fee will still apply.

6. Deposits

All treatments require a deposit to secure the booking. If cancelled more than 48 hours in advance, this deposit will be refunded. In case of late cancellation or no-show, the deposit is non-refundable.

7. Gift Cards

  • Gift cards are valid for 12 months from the date of purchase.

  • Gift cards are non-refundable and cannot be exchanged for cash.

  • Lost or stolen gift cards are the customer’s responsibility.

  • Gift cards can be used for both treatments and product purchases, unless otherwise stated.

8. Treatments, Health & Liability

  • Our treatments may involve the use of chemical or cosmetic products that can, in rare cases, cause allergic reactions.

  • Our treatments involve the use of professional cosmetic and chemical products that are carefully selected for quality and performance. While our team is trained to the highest standards and we always strive for client satisfaction, we cannot guarantee specific outcomes.

    Hair and skin respond differently from person to person, and results may vary depending on individual factors such as:

    • your current and past hair condition and treatment history,

    • your health, medications, and allergies,

    • and how you care for your hair or skin after the appointment (e.g. products used at home, heat styling, washing routine, etc.).

    We use our best knowledge, skill, and premium products to deliver excellent results. However, beauty is subjective, and satisfaction is personal.
    BRUSH cannot be held liable if the result does not meet subjective expectations, provided the treatment was performed professionally and in line with your consultation.

  • You are required to disclose any allergies, medical conditions, or sensitivities prior to treatment.

  • Additionally, you must inform us of your hair history, including:

    • any previous color treatments (professional or at-home),

    • products used (e.g. box dye, bleach, keratin treatments),

    • and any chemical processes that may affect the outcome or safety of the service.

    Failure to provide accurate information may result in damage or unexpected results, for which BRUSH is not liable.
    By booking a service, you confirm that you understand and accept these terms.

  • BRUSH is not liable for any injury, adverse reactions, or dissatisfaction resulting from treatments, unless liability is imposed by law.

  • By booking a service, you confirm that you understand the possible risks and accept these terms.


FINAL PROVISIONS

  • All agreements and disputes are governed by Dutch law.

  • If a dispute arises, we will first try to resolve it amicably. If unsuccessful, it may be submitted to a competent Dutch court.
